US Judge Orders Freedom of Kilmar Abrego Garcia from ICE Detention

A court has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, concluding his ongoing confinement is without lawful basis.

"Since his release after erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis stated in her ruling.

The case originates in a mistaken removal to El Salvador in March, which the government later acknowledged was an error. After his repatriation to the United States to face alien smuggling charges, he was held in immigration detention.

In her order, the judge pointed out that the authorities lacks a valid removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this juncture."

Context of the Legal Challenge

The court challenge center on disputed assertions. While the former administration contends that Abrego Garcia is a affiliate of the MS-13 gang, he categorically disputes this claim.

He has also entered a not guilty plea to the conspiracy counts, which are part of a separate criminal case in the state of Tennessee.
